2. Scope
These General Terms and Conditions of Sale govern purchases made through the website www.enotecaguanella.it.
Online sales and delivery of products are currently available exclusively within Italy.
3. Products and Prices
The essential characteristics of the products are described on the relevant product pages available on the website.
Prices are expressed in euros and include VAT, unless otherwise stated. Any shipping charges and other applicable costs are shown before the order is completed.
Product prices and availability may change. The price and conditions displayed at the time the order is submitted apply to that order.
4. Conclusion of the Contract
Before submitting the order, the Customer can review the selected products, quantities, prices and any additional charges, and correct any errors.
By submitting the order, the Customer declares that they have read and accepted these General Terms and Conditions of Sale.
The Seller sends a confirmation containing the information relating to the order to the email address provided by the Customer.
The Seller reserves the right not to accept or to cancel an order in the event that a product is unavailable, the information provided is incomplete or incorrect, payment cannot be processed, or other circumstances prevent the proper fulfilment of the order.
If an ordered product becomes unavailable after payment has been made, the Customer will be informed and any amounts already paid will be refunded.
5. Payment Methods
The payment methods currently available are:
- Bank transfer: the order is processed after receipt of payment has been verified. Bank details and the instructions required for payment are provided during the ordering process or in the relevant order confirmation.
- Cash on delivery: payment is made upon delivery with an additional charge of € 5.33, shown before the order is completed.
6. Shipping and Delivery
Orders are shipped exclusively within Italy. Applicable shipping charges are shown during the purchasing process and in any event before the order is completed.
Any delivery times indicated refer to normal circumstances and may vary due to circumstances not directly attributable to the Seller. This does not affect any rights and protections granted to consumers under applicable law.
7. Right of Withdrawal
Consumers have the right to withdraw from the contract, without having to provide any reason, within 14 days from the day on which they acquire physical possession of the products, except in cases where the right of withdrawal is excluded by law.
To exercise the right of withdrawal, the Customer must inform the Seller, before the expiry of the withdrawal period, of their decision to withdraw by means of an explicit statement sent to: info@enotecaguanella.it.
Following withdrawal, the Customer must return the products without undue delay and in any event within 14 days from the date on which the decision to withdraw was communicated.
The direct costs of returning the products are borne by the Customer, unless otherwise stated.
The Seller will refund the amounts due within 14 days from notification of the withdrawal, in accordance with applicable law. The refund may be withheld until the products have been received or until the Customer provides evidence that they have returned them, whichever occurs first.
8. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the cases provided for by law, including, where applicable, the supply of goods made to the consumer's specifications or clearly personalised, and goods which are liable to deteriorate or expire rapidly.
9. Legal Guarantee of Conformity
Consumers are entitled to the legal guarantee of conformity provided for by Articles 128 et seq. of Italian Legislative Decree No. 206/2005 (Consumer Code), within the limits and under the conditions established by applicable law.
The guarantee covers any lack of conformity already existing at the time of delivery and does not cover alterations or deterioration resulting from improper storage, exposure to heat sources, temperature fluctuations or other conditions occurring after delivery that are not attributable to the Seller.
